LifeStone Headstones and Memorials Terms and Conditions 

Terms and Conditions of Service 

1. Definitions  

1.1. LifeStone: Refers to LifeStone Limited, its successors, assigns, or any agents or employees. 
1.2. Customer: The individual or entity purchasing goods or services from LifeStone. 
1.3. Goods: All headstones, memorials, plaques, and related products supplied or services provided by LifeStone to the Customer.  

2. Health & Safety  

2.1. LifeStone will not assume any obligation as the Customer’s agent or otherwise under the Health and Safety at Work Act 2015, unless the work is conducted on LifeStone’s premises. 
2.2. INSTALLATIONS ON SITE: LifeStone LTD staff and/or contractors may choose not to complete memorial work in a Cemetery, Urupa, or other locations where the client or their associates are present if we feel any risk or hazard is added. Any costs associated with LifeStone's decision not to complete memorial works on site due to the presence of the client, their family, or associates will need to be met in addition to what has been charged.  

3. Payment Terms  

3.1. A 50% deposit is required to commence any works. 
3.2. The remaining balance must be paid upon approval of the design by the family and before production, shipping, collection, or installation. 
3.3. Payments made by credit card will incur an additional 2% fee. 
3.4. Interest may be charged on any overdue amount at the rate of 1.5% per month. 
3.5. Any expenses incurred by LifeStone in the enforcement of these terms (including legal costs and debt collection) shall be paid by the Customer.  

4. Deposit and Cancellation  

4.1. The Customer shall pay the deposit to LifeStone. 
4.2. The Customer has ten (10) working days from the Date of Order to cancel and receive a full refund of the deposit. 
4.3. If the Customer cancels after ten (10) working days, LifeStone may retain up to 25% of the deposit and any additional costs incurred. 
4.4. The quotation is not accepted by LifeStone until the deposit is paid in full.  

5. Ownership  

5.1. Ownership of any Goods supplied by LifeStone will not pass to the Customer until full payment is received. 
5.2. Until ownership passes, LifeStone may repossess any Goods and enter any premises where the Goods are situated to do so. 
5.3. The Customer shall indemnify LifeStone for any liability resulting from the repossession of the Goods.  

6. Consumer Guarantees Act 1993  

6.1. Where the Customer is a business, the Customer agrees that the Consumer Guarantees Act 1993 does not apply.  

7. Liability and limitations 

7.1. If a claim for damaged goods or faulty workmanship is accepted, LifeStone may correct or replace the defective Goods or refund the amount paid. 
7.2. LifeStone shall not be liable for any indirect or consequential loss or damage. 
7.3. LifeStone’s liability shall be limited to the contract price of the defective Goods.  

8. Collection & Use of Information  

8.1. The Customer authorizes LifeStone to collect, retain, and use any information about the Customer for assessing creditworthiness and enforcing rights under these terms. 
8.2. The Customer authorizes LifeStone to disclose any information obtained to any person for these purposes.  

9. Section 9 – Limited Product Warranties 

The following warranties apply only to material defects that render the product unfit for its intended memorial purpose. All warranties are subject to the Conditions, Exclusions and Claim Procedures set out in subsections 9.8–9.10. 

9.1 Scope of Coverage 

  • Covers material defects in raw product (cracks, delamination, spalling) under normal environmental exposure. 

  • Does not cover damage from improper installation, vandalism, misuse, extreme weather events, graffiti, chemical cleaners, or natural patination. 

9.2 Conditions 

  1. Products must be installed by a LifeStone-approved installer in accordance with LifeStone’s installation guidelines. 

  1. Routine cleaning and maintenance must follow LifeStone’s published care instructions. 

  1. Any field-cutting, on-site modification or re-engraving must be authorised in writing by LifeStone. 

 

9.3 Warranty Periods

Laser-Engraved Non-Ferrous Metal Plaques

Covers oxidation that impairs legibility. 

 

 

9.4 Exclusions 

  • Natural stone veining, slight color variation, moss or lichen growth, micro-fissures 

  • Damage from acid rain, salt spray (coastal sites), freeze/thaw cycling beyond standard conditions 

  • Acts of God (earthquake, flood, fire, lightning), third-party damage 

9.5 Remedies 

At LifeStone’s option, validated claims will be remedied by: 

  1. Repair or re-finish of the defective portion; or 

  1. Replacement of the defective product, pro-rated by the unexpired warranty term; or 

  1. Refund of reasonable portion of original purchase price (if neither repair nor replacement is practicable). 

 

9.6 Claim Procedure 

  1. Notify LifeStone in writing within 30 days of defect discovery. 

  1. Include proof of purchase, photos of the defect, and installer details. 

  1. Permit site inspection by LifeStone or its authorised agent. 

  1. LifeStone will respond with acceptance, denial or proposed remedy within 30 days of inspection. 

9.7 Transferability & Limitations 

  • Warranties are transferable one time to a subsequent property owner, provided LifeStone is notified in writing within 60 days of property transfer. 

  • All implied warranties (fitness for purpose, merchantability) are limited to the express terms above and to the maximum extent permitted by law. 

  • LifeStone’s maximum liability under these warranties shall not exceed the original purchase price paid for the defective product. 

 

By aligning durations and coverage with leading New Zealand and international memorial suppliers, and by adding clear conditions, exclusions and claim processes, these warranty provisions safeguard LifeStone while offering families peace of mind. 

10. Events Beyond Control  

10.1. LifeStone is not responsible for delays or cancellations caused by events beyond their control (e.g., COVID-19, natural disasters, weather, international market disruption).  

11. Shipping / Transport  

11.1. LifeStone is not responsible for any damage, loss, or delays caused by the transport company but will support recovery actions against the third party.  

12. Pick Up  

12.1. The Customer must inspect goods at the time of pick-up. LifeStone is not liable for any damage incurred during transport or installation once the goods are picked up.  

13. Materials Supplied by Client  

13.1. Any materials supplied by the Customer must be provided promptly. Delays in providing materials may impact the timeline for the headstone and are not the responsibility of LifeStone. 
13.2. Any imagery or photos provided by the client must be no less than 2MB in size. Smaller image files may result in blurred results for memorial photos and plaques. LifeStone will do all in its power to improve files provided; however, low-quality files may result in pixelation in the final memorial product. LifeStone does not take any legal responsibility and consequence caused.  

14. Final Payment  

14.1. Final payment is required at the time of final production approval. All outstanding amounts must be cleared before installation, transportation, or pick-up of the memorial.  

15. Uncollected / Unpaid Goods  

15.1. If goods are not fully paid for or remain uncollected within three months from the cutoff date, LifeStone reserves the right to resell, dismantle, or dispose of the goods to recoup costs.  

 

 

16. Cancellation Policy  

16.1. This is a binding contract. Cancellations may not be accepted after confirmation. LifeStone reserves the right to recover all expenses and costs incurred before returning any monies due to cancellation.  

17. Change of Mind  

17.1. LifeStone is not required to provide a refund if the Customer changes their mind, finds a similar product or service elsewhere cheaper, or due to a change in plans or circumstances.  

18. Production Timeline  

18.1. LifeStone requires no less than six (6) weeks following the production sign-off from a client. Any delay by the client to provide information, input, and/or production sign-off that pushes the production timeline out beyond the unveiling date, given LifeStone's six-week production timeline, will be the sole responsibility of the client.  

19. Production Sign Off  

19.1. Production sign-off is required at least six weeks prior to the unveiling date. Late approval may require postponing the unveiling date.
